PRESIDENT'S MESSAGE

     Well, we've started off 2006 with some really great, informative meetings.  Thanks to Hank Davis,  we gained some insight into the workings of Mather Hospital and Veterans benefits and then it was a full house when Mr. Uldricks, VA Rating Specialist from Oakland clued us in on the claims process.  Looks like the March and April meetings will be first rate also.  But, hey, we need to have some fun too.  So, let's all get together at the St. Patrick's Day Parade, where for us it will be the "wearin" of our own kind of green.  Hope I get to see you there.
     Coming up in April are also Chapter elections.  Want to have a say in the Chapter business?  Now's your chance.  Nominations are this month.  More on this inside.
     On a sad note, I want to express my sympathies to Judith Salgado, wife of Robert Salgado, longtime AVVA member who left us early in February.

Charlie received a Congressional Appointment to the U. S. Air Force Academy and graduated in 1972. As a rescue helicopter pilot based in Thailand at the end of the Vietnam War, he participated in the evacuation of Phnom Penh, and the Mayaguez incident. he was awarded the Distinguished Flying Cross for actions in the Mayaquez incident.
     After six years in helicopters, he transitioned to fixed wing reconnaissance aircraft, flying missions in support of operations in Panama, Grenada, Lebanon and other countries.
      The above are just the highlights of Charlie's career.  Now he is taking on a whole new career.  He is running as a Democratic candidate for the  CA 4th Congressional District.  For the last several years, we've all heard the complaint that there are hardly any Veterans in Congress and/or the Senate.  So, Charlie is stepping up to the plate.  So, whether you are Democrat or Republican, come and listen to what he has to say and tell him what you want as a Veteran.

MORE FOR VETERANS IN THE NEW BUDGET??

     Well, we guess it depends on who is doing the figuring.  Check out this article from the RAO Bulletin:
BUDGET PROPOSAL IMPACT ON VETS:  Speaking on veterans' issues at the American Legion convention 24 FEB, President Bush said that members of Congress have learned a powerful message over the years: "Don't mess with America's veterans." Ironically, the President himself has failed to learn this lesson. In the same week he made this observation, the Associated Press highlighted his effort to force eligible veterans off TRICARE by increasing co-payments for prescription drugs and the program's enrollment fees. In his budget proposal to Congress veterans are once again being asked by this administration to accept funding levels and out of pocket expenses that will impact unfavorably on their quality of life. Congress has the authority to accept, reject, or amend this Budget. If vets do not effectively communicate to their legislators their dissatisfaction with the current proposals they will only have themselves to blame when similar funding shortages for vets are presented to Congress in the remaining years of this administration's tenure.  The president in telling Congress not to mess with veterans is telling veterans to speak up now or suffer the consequences.  If your words fall on deaf ears use of the voting box later this year is the ultimate way to convince Congress to act on their constituents concerns.  Following are elements of the 2007 Budget proposal that point to where vets fit in this administration's present and future priorities:

1.)  Raises veteran out of pocket health care costs for the fourth year in a row. Imposes  new fees for one million veterans, costing them more than $2.6 billion over five years and driving at least 200,000 veterans out of the system. It would double the co-payment for prescription drugs from $8 to $15, and impose an enrollment fee of $250 a year for category 7 and 8 veterans, who make as little as $26,902 a
year.
2.)  Increases TRICARE health care premiums for 3.1 million military retirees under 65. Premiums will double for senior enlisted retirees and triple for officer retirees by 2009 and drug co-payments will increase -- costing military retirees $2.4 billion over five years. These fee increases of more than $1,000 could drive more than 144,000 military retirees out of the TRICARE system.
3.)  Provides $1 billion less than veteran's service organizations specify is needed, and is $10 billion below the amount needed to maintain services at current levels over the next five years.
4.)  Maintains VA funding inadequacies will be offset by anticipated $1.1 billion in new VA management efficiencies.  This in spite of a Government Accounting Office report requested by Congress that indicates this is highly unlikely.

ROBERT SALGADO
IN PEACE AT 51 YEARS,  FEBRUARY 6, 2006

 

     Robert was a long time AVVA member.  His cousin died in Vietnam.  To honor that cousin, Robert joined the Chapter.  He worked hard for Veterans within the Chapter until he became ill with diabetes, which progressively became worse with each passing year.  The above picture was taken one of those times a couple of years ago when he answered an emergency call to help guard the Vietnam Veterans Memorial because of a  possible threat of vandalism.  Rest in peace Robert, we will miss you! 

 

     Many members of Robert's family reside in Stockton.  A service was planned for him there.  We are awaiting word regarding a service for him here in Sacramento.  Will let you know when arrangements are available.

Jones Launches Effort to Protect Seniors and Dependent Adults

     When someone is unable to manage their own affairs, a court may appoint a "conservator" to manage that person's financial and other affairs. But, California's conservatorship system for elderly and dependent adults, originally designed to protect vulnerable adults from fraud and abuse is failing to protect them and may be contributing to their abuse.
     Helen Jones was a real-life "Rosie the Riveter."  She worked and served all her life.  She is alert, responsible and self-sufficient.  She values her independence, but today, at age 87, both her person and her estate are controlled by a court-appointed conservator.
     Helen never consented to this arrangement.  Her court appointed private conservator spent $200,000. of Helen's estate - $84,000. per year - mostly on things Helen never wanted.  The conservator doled out an allowance and decides which doctors she will see.  The conservator has ignored some of Helen's most important wishes.  Contrary to Helen's express wishes, the conservator had her brother cremated instead of buried.
     The current system allows private conservators to get themselves appointed inappropriately.  Some steal or mismanage the money their conservatees - people like Helen Jones - spent a lifetime earning.  The probate courts do not have sufficient resources to catch the abuses.  Worst of all, the system provides no place to turn for help.
     This system is out of control and failing the people it is supposed to protect.  It is not enough to look for band-aid fixes for a system that is truly broken.  To fix the system, I recently introduced Assembly Bill 1362, the Omnibus Conservatorship Reform Act 0f 2006, which will comprehensively reform the conservatorship system.
     First, the bill will require annual court review hearings for all conservatorships, along with annual accountings by conservators which are supported by back-up information and subject to audit.
     Second, by bill will provide increased resources and training for the courts, provide more judges, more court attorneys and more court investigators to provide oversight of conservators.  The courts will also be required to provide assistance to family members and friends who are acting as conservators, but need assistance navigating the legal system.  All participants in the conservatorship system, including judges, court investigator, court attorneys, private conservators and public guardians, will be required to provide oversight of conservators.  The courts will also be required to provide assistance to family members and friends who are acting as conservators, but need assistance navigating the legal system.  All participants in the conservatorship system, including judges, court investigators, court attorneys, private conservators, and public guardians, will be required to satisfy both initial training and qualifications requirements, along with an annual continuing education mandate.

1/21 - Several VVA500 members attended the graduation of several of the Norcal Young Marine Recruits to status of Young Marines.
1/31 - E. D. McNeill met with Sac. Parks and Recreation to recap Veterans Day Parade costs and after action matters.
2/7 - The regular VVA500 Board Meeting was held.  The Board decided that we would man a fireworks stand for the 4th of July time period.  It was also decided to support the "Hands across the World" project.
2/8 - VVA500 members attended the VAC meeting.
2/18 - Secretary McNeill attended Norcal Young Marine Training.
2/20 - Secretary McNeill attended the Maine Corps League #940 meeting.
2/21 - VVA500 General Meeting.  Mr. Uldricks, VA Rating Specialist gave a great presentation on the process of filing claims. 
2/28 - The VVA500 Board held a special Board of Directors Meeting.
3/3 - Several VVA500 members attended an informal get-together of the "Wolfhounds" at the Vietnam Veterans Memorial.
3/4 - 5 - Sec. McNeill and CSC delegate attended the quarterly CC meeting in Fresno.

SERVICE ACADEMY APPLICATIONS
They're looking for a few good applicants.

     Do you have a family member that might be interested in attending one o the Service Academies?  Are they looking for a recommendation?  Each year, Congresswoman Matsui nominates a small number of young people to the United States military service academies.  Selections are made on the basis of SAT scores, academic transcripts, and an interview with the Academy Selection Advisory Committee, which takes place in Sacramento in early December.
     All military academies require that nominees be a citizen of the United States between 17 and 23 years of age, be unmarried, and have no children.

5.)  Estimates fewer returning veterans from Iraq and Afghanistan being served by the VA in 2007. However, a GAO audit has found the Bush Administration's budget numbers on veterans' health care to be unreliable based on previous year's projections.

6.)  Continues to deny VA health care funding for new (priority 8) veterans. Lack of funding since 17 JAN 03 has prevented 1 million veterans, who make as little as $26,902 a year, from enrolling in VA health care.
7.)  Funds 17,100 fewer Army National Guard and 5,000 fewer Army Reserves than are authorized by law.
8.)  Lacks funding that would allow repeal of the Disabled Veterans Tax, which forces disabled military retirees to give up one dollar of their pension for every dollar of disability pay they receive. The budget continues to require nearly 400,000 military retirees with service-connected disabilities to continue to pay the Tax.
9.)  Lacks funding that would allow ending the Military Families' Tax. The Survivor Benefit Plan penalizes
survivors, mostly widows, of those killed as a result of combat. These widows lose their survivor benefits if they receive Dependency and Indemnity Compensation benefits because their spouse has died of a service-connected injury. The President's budget forces these 53,000 spouses to continue to pay this unfair tax, even though these families have made the greatest sacrifice for our country.
10.)  Increase of 14% for Mental health services is inadequate to meet growing need for Iraqi veterans. An Army study shows that about one in six soldiers in Iraq report symptoms of major depression, serious anxiety or post- traumatic stress disorder, and some experts predict that the number eventually requiring mental health treatment could exceed 170,000. According to a 27 JAN 06 UPI report up to one-third of Iraq war veterans are suffering from some degree of PTSD
11.)  Decreases by $13 million the funding of medical and prosthetic research.  This would set the research grant program back years, just as many troops in Iraq and Afghanistan are coming home with injuries that require this expertise.

     You can!  The California State Military Reserve wants you! The job of the SMR is to provide support and training to the CA National Guard.  There is no risk of overseas deployment.  The SMR soldiers are serving as base security, running State HQ, and other State Active duty positions.  Usually the SMR volunteers are not deployed outside CA, but about 77 were activated for the first out of state deployment to help with the Katrina response.  Currently there are about 600 men and women in the SMR, they are looking to raise the ranks to 3000.  There is no physical training, just be able to qualify to perform the duties, disability waivers are available.  If you want more information, call Major Rick Lalor at:  562-795-2898, e-mail:  richard.lalor1@us.army.mil or check the website at www.calguard.ca.gov/casmr.  Member John Madri belongs to the SMR.

 

    CONSERVATORSHIP LEGISLATION, CONT.

Third, the legislation will require that private conservators are subject to real standards by requiring that they be fully licensed and regulated by the Department of Consumer Affairs.  The Attorney General will have the power to enforce those regulations and requirements, and prosecute conservators who steal from and mistreat those they are charged with protecting.
       But a system that regulates private conservators is not enough.  My legislation will also prevent abusive practices by establishing statewide, uniform standards on what conservators can do, including standards for fees, standards for managing assets, and tightening up requirement for bonding of conservators.  These requirements will apply to all conservators.  These requirements will apply to all conservators, including family members, and friends who take on this role.
     I am also seeking to increase both the resources and the responsibilities of the Public Guardian in each county.  The Public Guardian's Office is responsible for overseeing the affairs of low-income seniors and other adults unable to manage for themselves.  But, public guardians too often turn away seniors due to lack of resources.  My bill will require that the Public Guardian take the cases of all needy adults who met the criteria for services, and will increase funding for the Public Guardian by permitting them to take certain middle-income cases, with established fee scales.
     Finally, this bill will create a true system of checks and balances by establishing independent oversight of the entire conservatorship system through a Conservatorship Ombudsman within the Department of Again.  The ombudsman will be charged with investigating and resolving complaints of abuse made by, or on behalf of, conservatees.  It will be a place that caring family and friends could turn for help.  If the ombudsman existed today, many of the shocking stories of abuse that we have read and heard about could have been prevented.
     It is unconscionable that these abuses have been allowed to occur for too long.  AB1363 is wholesale reform of the conservatorship system in California today, from top to bottom, designed to prevent harm to our parents, our friends and our seniors and allow them to enjoy what should be their golden years.

Note:  This legislation can be important for Veterans because many of our disabled Veterans have conservators assigned to them.  While the conservator is appointed by the VA and must fit the criteria and requirements of the VA, this doesn't necessarily mean that the Veteran is being served well by the conservator and the same abuses as described above can also be happening to Veterans.  The possibility exists that "conservators" can be acting for non-Veterans and Veterans alike at the same time.  So, if the law is enacted, there will be public access to the names of those conservators that are determined by the system to be abusive, etc.  This would be a check and balance situation to make sure that our Veteran "conservatees" and their affairs are being taken care of properly.

CHAPTER ELECTIONS

     It's time to nominate our 2006-2007 Officers and Board Members.  The elections will be held at the General Meeting in April.  The only qualifications are that you be willing to do the job and are a paid-up member of the Chapter.  You also have to be a paid up member to vote.  Yes, it normally does mean one more meeting a month.    The Officers to be elected are:  President, Vice-President, Secretary, and Treasurer.  There are three Board Members to be elected. Another office that must be filled is the AVVA representative.  This person of course comes from the AVVA members. Per the VA constitution the Officers' duties are as such:
President:   shall be the chief executive officer of the Chapter and shall, subject to the direction of the Board of Directors, supervise and control all of the business affairs and property of the Chapter, and shall see that all orders and resolutions of the Board are carried into effect. The President shall preside at all meetings of the members and of the Board, and shall appoint all chairpersons of committees, except the Chairperson of the Nominating Committee.
Vice-President:  In the absence of the Chapter President, or in the event of his or her inability or refusal to act, the Vice President, or in the event that there be more than one (1) Vice President, the Vice Presidents in the order designated, shall perform the duties of the President, and when so acting, shall have all the powers of, and be subject to, all the restrictions upon the President. The Vice Presidents shall perform such other duties as the Board may from time to time prescribe. In the event of the death, removal, or resignation of the President, the Vice President shall assume the position of the President for the remainder of his or her term.
Secretary:  shall record all the proceedings of the meetings of the Board of Directors, and of the members, in a book kept for that purpose, and shall perform like duties for the Executive Committee when required. He or she shall give or cause to be given, notice of all meetings for which notice is required by this Constitution, and shall operate under the supervision of and perform such other duties as may be prescribed by the Board of Directors or the President. In the event of a conflict, the Secretary shall act pursuant to the instructions of the Board. The Secretary shall obtain and have custody of a corporate seal for the Chapter if required by law. The Secretary or Assistant Secretary shall have the authority to affix the same to any instrument requiring it, and when so affixed it may be attested by the signature of the Secretary or such Assistant Secretary. The Board may give general authority to any other officer to affix the seal of the Chapter and to attest the fixing by his or her signature. The Secretary shall be responsible for the safe-keeping of all DD Forms 214 or other acceptable forms of proof of military service tendered to him or her by any member. He or she shall forward to the office of the Corporation a copy of said form for each duly elected officer and director. The Assistant Secretary, if there be one, shall, in the absence of the Secretary or in the event of his or her inability or refusal to act, perform the duties and exercise the powers of the Secretary, and shall perform such other duties and have such other powers as the Board may from time to time prescribe.

Treasurer:  shall have charge and custody of all funds and securities of the Chapter and all funds and securities in any way generated, collected, or obtained in connection with Chapter activities; and the Treasurer shall be responsible for such funds and securities and the receipt and disbursement thereof. He or she shall keep full and accurate accounts of receipts and disbursements in books belonging to the Chapter and shall deposit all moneys and other valuable effects in the name of, and to the credit of, the Chapter in such depositories as may be designated by the Board.  The Treasurer shall disburse the funds of the Chapter as may be ordered by the Board, taking proper vouchers for such disbursements, and shall render to the President and the Board at its annual meeting, or when the Board, the President, or the Corporation so require, an accounting of all transactions as Treasurer, of the financial condition of the Chapter, in compliance with local, state, and federal regulations.
Board of Directors: shall be responsible for the control and management of the affairs, property, and interests of the Chapter; for keeping the Corporation advised of all activities of the Chapter; for complying with all reporting requirements established by this Constitution, the rules, resolutions, or directives of the Corporation, or any local, state or Federal law; and for guiding and administering the Chapter so that the purposes, principles, and goals of the Corporation, as set forth in the Certificate of Incorporation, and the rules, resolutions, and directives of the Corporation are followed; and for making suggestions and recommending programs.
     There is also a Nominating Committee of three that must be elected.  A State Delegate to the CA State Council must be elected.  This individual must be willing to attend the Council meetings every quarter in Fresno and report of activities be made to the Chapter. 
     After a President is elected, he will choose Committee Chairs for our various committees.  A list of committees and descriptions will be distributed at the March and April meetings, and will be published in the May newsletter.  Members can review them and decide if they would like to be a chair or join a committee of interest.
     OK, everyone, don't panic.  All of these duties seem like a lot of work that you don't have time for.  That's where you Executive Director come in.  Other than the Treasurer duties, the Executive Director under the direction of the Board handles the administrative duties of the Chapter.  So, don't be afraid to run for any office you would like and become an active member of the Chapter.  Also don't be afraid to nominate someone for any position.  They are contacted upon nomination and have the choice of accepting the nomination or not.  By the way, elections are by secret ballot.  And, we won't tell them who nominated them.

NOTICE OF DISCONTINUED MEMBERSHIP

     After due consideration, and decision of the Board on February 28, 2006,  VVA500 has dropped it's membership in the Veterans Affiliated Council and at this time has no plans for renewal.  This decision was due to actions by VAC that the VVA500 Board considered unethical and unprofessional.  A letter has been sent to VAC regarding this decision.

NOTICE OF SCHOLARSHIP AWARDS

Vietnam Veterans of America, Chapter 500 will be awarding scholarships in the amount of $500.00 each to graduates of high school and/or holders of a GED that will attend a college, university, or vocational school in 2006.  The scholarships will be awarded in honor of three VVA members who have passed away, B.T. Collins, Gil Murray, and Bill Wolf.  Dennis Kauffman, chair of the Scholarship Committee has announced the criteria for receiving the scholarships.  The Scholarship Committee will select the recipients based on the merits of an ESSAY.  APPLICANT MUST be a resident of counties in the Sacramento Valley, which are:  Butte, Colusa, Glenn, Placer, Sacramento, Shasta, Sutter, Tehama, Yolo, and Yuba.  The applicants also must meet the following requirements of the Chapter:

 

1.  MUST be a dependent or relative as such of a Vietnam Era Veteran (Jan 1, 1959-May 7, 1975).  The relative may be a son, daughter, grandson, granddaughter, nephew or niece. 

 2.  MUST provide a copy of the Veteran’s DD214 or submit proof of military service (if DD214 is not available the veteran and applicant MUST have an interview with the Scholarship Committee to show proof of service).

 3.  MUST submit a copy of their paid registration to an accredited school, college, or university.

 4.  MUST complete an ESSAY on the specified topic listed below, 300-1000 words typed or handwritten (neatly) with a cover page listing the following information:  name, name of high school, or evidence of holding a GED,  address, phone number, name of college, university or school he/she will be attending in the fall, and your educational goals.

 5.  MUST submit ESSAY by July 1st, 2006 or MUST be postmarked by 12AM, July 1st, 2006.  Recipients of the scholarships will be notified by August 31st, 2006

 

THE TOPIC FOR THIS YEAR IS:

"Explain how Vietnam Veterans paved the way for a psychological definition as well as treatment for Post Traumatic Stress Disorder for themselves, future generations of servicemen and women as well as the public at large".

 

     Notices of the scholarship awards are being sent out to the career counselors of high schools, colleges and vocational schools.  If you know of some person who might be eligible for a scholarship, pass this information along or ask the office to send it along to them.  Just remember, how we fare in the future depends upon the young.

 

                                             OPERATION RECOGNITION

 

DID YOU MISS GRADUATING FROM HIGH SCHOOL DUE TO MILITARY SERVICE IN WORLD WAR II, THE KOREAN WAR, THE VIETNAM WAR, OR INTERNMENT IN A WORLD WAR II RELOCATION CAMP?

ATT:  VETERANS AND JAPANESE AMERICAN CITIZENS!!

 

     You may be eligible to receive a high school diploma from the Sacramento County Board of Education.  To qualify you must have served in any of the above wars and have an Honorable Discharge or interned as above, and you must currently reside in Sacramento County or attended a high school in Sacramento County prior to enlistment or internment. 
     If you have a qualifying family member who is now deceased, you may apply for posthumous recognition.  There is no charge to participate in Operation Recognition.  The deadline to apply is April 21, 2006.  For an application, call the Sacramento County Office of Education at:  916-228-2449 or you can download the app. at www.scoe.net/or.

ATTENTION AIR FORCE VETERANS

 

     AIR FORCE MEMORIAL: The United States Air Force is the only branch of service that does not have any memorial in the Washington DC area commemorating its service to the nation. However, it is the second highest (53,000 plus) of any of the four armed services in combat casualties. Recognizing the need for a memorial Congressional Legislation in 1991 authorized the existence of the Air Force Memorial Foundation (AFMF) for the primary purpose of building one.
     The memorial will now be located at a promontory point of land known as the Naval Annex. The site overlooks the Pentagon from the southwest and is located just off Interstate 395 (a major gateway to DC).
     Construction has begun and the Memorial is expected to be finished in mid-September of 2006.

DIRECTIONS to the Roseville Veterans Memorial Hall.  From I-80.  Take the Douglas West exit.  Go to the third light which is Folsom Rd.  Turn right, go to the second stop sign, which is Sutter, turn left, follow the curve, you will see a sign on the right and left that says "Royer Park", turn left there.  You will immediately see the hall to the right and the parking lot.  That's it.  In the hall, from the main door, follow the VVA sign to the meeting room. When you leave, the street is one way, so you will go to the right.  You will then come up to Douglas Blvd., left will go back to the freeway and whichever direction you need to go from there.
