PRESIDENT'S MESSAGE

Dear Chapter Members:
     May was a good month for our chapter.  Our general membership is increasing, our meeting attendance is up, and three new members came to the meeting.
     The heart of our chapter is always about our members, and our service to this community.  We have added services in our new office over the past year to serve our chapter members and all veterans that seek assistance.  We plan to expand those services in the future.
     The core mission of our chapter will never change.  Our focus is on our members and welcoming our veteran brothers and sisters home into our local friendly chapter environment will always stay the same.
     We will always say, Welcome Home, Thank you for your Service and how can we help?  That is constant principle that will never change.
     We also had an incredible month of special chapter activities, including our 11th annual "Reading of the Names on May 30th.  Thanks go out to our VVA and AVVA members, volunteers from the community.  Dave Bender, our traditional emcee of course, did an outstanding job.  It was so fitting to honor General Ware as well.  And a special "Oorah"   for our Marine Cadets who did such an outstanding job.
     I do think that we all made that day special from all our lips, to our fallen hero's ears, that we will never forget the total sacrifice they made for our Country and allowing us to be free.  It is our Chapter's honor and privilege to host this ceremony every year and will always continue this tradition.
     Many other activities took place that weekend and were attended by various VVA members and staff.  Some of us worked as volunteers on the No Excuse 5k Run.

OTHER BUSINESS TO BE TAKEN CARE OF
AT THE AUGUST MEETING.......

     Alan Hayashi has resigned his office as Vice-President of VVA500 for personal reasons.  The Board has accepted his resignation and thanks Alan for his service to the chapter. 
     Per the VVA Constitution in regard to resignation, death, etc., the Chapter Board is to appoint another member to fill the vacated office.  The appointment is to be approved by the membership at the next meeting. Therefore Ted Adams nominated Jim Singleton for Vice-President and the Board  voted to approve and has appointed Jim Singleton, a current Board Member as Vice-President.
     With Jim moving to the Vice-President office, another member would be needed to fill the vacant Board Member slot.  Per the VVA Constitution, this position shall be filled by a majority vote of the remaining Board Members.  Therefore, Marty Snezek was nominated by Ted Adams to fll the vacant Board seat.  The Board approved the nomination and voted for Marty to fill the position.
     CONGRATULATIONS TO YOU BOTH!
      So, in addition to our speaker, at the August meeting,  the membership will need to approve Jim Singleton as Vice-President and welcome Marty as a new Board Member.

ISCHEMIC HEART DISEASE, PARKINSON'S DISEASE OR
B-CELL LEUKEMIA?????

                                                    From the VA Watchdog.....
     Sen. Jim Webb (D-VA), chief architect of the pricey Post 9/11 GI Bill education benefit for veterans of the Iraq and Afghanistan war era, could become a new champion, for taxpayers, against what he perceives as excess spending on military pay and on a new wave of Agent Orange claims.
     Webb, a former Navy secretary and decorated Vietnam War veteran, risked the anger of thousands of veterans from that war when he won Senate approval last week of an amendment to block, at least temporarily, the Department of Veterans Affairs from paying new disability claims on three prominent diseases presumed linked to wartime herbicide exposure.
     As many as 86,000 Vietnam veterans with ischemic heart disease, Parkinson's disease or B-cell leukemia are awaiting a final VA regulation to receive disability compensation based on a decision last fall by VA Secretary Eric Shinseki of evidence linking these diseases with exposure to deadly defoliant used during the war.  Many more vets could file first-time claims.
     VA officials not only have published interim regulations already but, for months have been encouraging veterans stricken with these diseases, or their surviving spouses, to file new claims or re-file claims as soon as possible because benefits would be paid back to the filing dates.
     But Webb proposed, and senators accepted May 27, an amendment to the fiscal 2010 war supplemental funding bill (HR 4899) to limit spending on claims filed for these new presumptive Agent Orange diseases for 60 days.  That will allow Congress time to study the VA decision and examine more closely the link found between these diseases and herbicide exposure.
     Immediately after the vote, Webb began a trip to Asia and could not be reached for comment.  He told Congressional Quarterly, however, that he wants Shinseki to explain his reasons for expanding last October the list of presumptive diseases tied to Agent Orange.  Congress, he said needs to hold VA to" an accountable standard" for such claims.
     The VA draft regulation, published in March, projected costs for Agent Orange claims will jump by $13.6 billion in a year and by $42.2 billion over 10 years.  By comparison, the projected 10 year cost of new Post-9/11 GI Bill benefits that Webb pushed into law is $52 billion.
     Webb first became involved in Agent Orange issues while staff director of the House Armed Services Committee in the late 1970's.  He has expressed concern to staff and fellow senators over the expanding list of diseases presumed caused by defoliants in Vietnam.  The Agent Orange Act of 1991 makes veterans who suffer from these presumptive diseases eligible for compensation even if they spent only a day in country. VETERAN LEGISLATION/NEWS

     President Harper also reports:   that June also was an impressive victory for our chapter.  Our Chapter along with the
Sacramento Veterans Affiliated Council and with the help of other veterans and veterans organizations won a political battle in Sacramento to keep the Sacramento County Veteran's Service office open for the fiscal year 2010-2011.
     As you recall, the office was slated for closing by the Sac County Board of Supervisors due to budget cuts.  We formed a veteran's coalition in Sacramento which I headed up to fight against these recommended cuts.  It was a two month campaign and we finally convinced the Supervisors to fully retain all the positions that were up for elimination during budget hearings.
     This was a case that all veterans from various organizations led by the chapter and the VAC came together to do what is right for our veterans.  In my 20 years of managing veterans programs in this town, I have never seen so many hats/caps come together in the County Board  chamber on June 2, 2010 and show strength of force to  change the decision of the Board to retain the program.
     As on County Board member told me during the break "It's very impressive to see so many veterans attend the hearing".  He indicated, it made a difference.  It just goes to prove, if we all come together for a common purpose and put our differences aside, we are a powerful and influential voice in this community.
     In summary, this was a huge political victory for us and all the veterans in this community.  I want to thank all of whom you  joined our coalition and made phone calls to the Board of Supervisors and those who showed up at the budget hearings.  Please take a bow for a job well done.       Semper Fi!  Don Harper

             JUDGE:  LAW PENALIZING FAKE HEROES
                  UNCONSTITUTIONAL    Associated Press                    
      (Excerpts from the article) Denver - A Law that makes it illegal to lie about being a war hero is unconstitutional because it violates free speech, a federal judge ruled July 16, as he dismissed a case against a Colorado man who claimed he received two military medals.  Rick Glen Strandlof claimed he was an ex-Marine who was wounded in Iraq and received the Purple Heart and Silver Star, but the military had no record the ever served.  He was charged with violating the Stolen Valor Act, which makes it a crime punishable by up to a year in jail to falsely claim to have won a military medal.
     U.S. District Judge Robert Blackburn dismissed the case and said the law is unconstitutional, ruling the government did not show it has a compelling reason to restrict that type of statement.  A spokesman for the U.S. Attorney in Denver said prosecutors are reviewing the decision and haven't decided whether to appeal.  The spokesman said that decision would be made by the U.S. Justice Department in Washington and prosecutors in Denver.
     The law has also been challenged in California and in a case now before the 9th U.S. Circuit Court of Appeals.

      Saturday, the 4th there will be a "Reading of the CA Names" beginning at 7AM, with a ceremony closing the "Reading" at 4PM.
      Monday, September 6, there will be a ceremony at 3PM for the Closing of the Wall.
      Tuesday, September 7, the Wall will be in take-down mode.
     We will need many types of volunteers; docents to cover the Wall for 24 hours a day, (security in the evening) and Readers for the Reading on Saturday.  VVA500 will be coordinating the event with East Lawn. To volunteer, East Lawn will be the initial contact point, call:  916-732-2020.

SMALL CHANGES IN GENERAL MEETING FORMAT

     We have had a request for more social time for the members.  Since we have several social events already scheduled, we will add social time to our General Meetings.  As many other organizations do, we will have a social hour beginning at 6PM before each meeting.  The General Meeting itself will still begin at 7PM.
     In addition for requests to shorten the meetings, we will limit committee reports to an enforced 5 minute limit and reduce the pizza time to 20 minutes and also limit the drawing time.

MORE FUTURE CHAPTER EVENTS

     Saturday, September 25th - VVA500 will celebrate it's first anniversary in our own Hall.  It will be from 1-4PM with a BBQ, Potluck Event.
     Friday, Saturday, Sunday, October 8, 9, 10 will be the annual Get-A-Way at Scott's Flat.  Start getting your gear together.  It will be time to get out into the great outdoors. Good food, good company, good fun.
     Thursday, November 11 - Veterans Day - There's the Parade in Elk Grove and possibly a small event at the Memorial.  More information on that when it comes.
     Saturday, December 18 - Time for the annual VVA500 Christmas Party.  This year will be a little different in that it will be the party plus our awards night.  Awards will be presented to businesses who have donated funds to VVA500 and plaques will be unveiled that contain the names of our past presidents and the charter members of VVA500.

WEBB DENIES CLAIM ADJUDICATION, CONT.

     What worries Webb, said one Capitol Hill source, is that, based on modest scientific evidence, VA could be paying claims on diseases that a large proportion of any population will contract through normal aging.
     Webb noted last week that a decision in 2001 making Type 2 diabetes a presumptive disease of Agent Orange exposure now allows 263,000 veterans to draw disability compensation.  He said projected estimates of heart disease alone among Vietnam veterans are much higher.
     Webb's amendment language, if agreed to by the House, would invoke the Congressional Review Act which allows a funding freeze on any major government regulation or initiative so Congress can review the proposed changes.  If in 60 days opposition strengthens and a majority of lawmakers will risk the wrath of expectant veterans with these ailments, Congress could pass a joint resolution to prevent a final regulation from taking effect.
     Webb serves on the Senate Veterans Affairs Committee and chairs the personnel subcommittee of the armed services committee.  A spokesman for Sen. Daniel Akaka (D-Hawaii), chairman of the veterans committee, said Akaka "is seeking more information from Secretary Shinseki about this, because of the potential impact of the ischemic heart disease presumption on the quality and timeliness" of services for all veterans.
     VA officials earlier had projected publication for final regulations on the new presumptive diseases by the late April or early May.  Shinseki even reduced the public comment period to only 30 days to speed up start of claim payments.  A VA spokesman now has no comment on publication. 
     Chapter note #2:  While Webb appears to be the bad guy in this situation, evidently the VA did not follow some rule protocol for Congressional  review either. At this time it is estimated that the regs may be finalized by the end of the year.  Webb pushing for fiscal discipline, has also questioned pay raises for the current military that would take effect next January.

                         BURN PIT TOXIC EMISSIONS
     The Veterans Affairs Department has issued guidance on how to determine benefits for vets exposed to environmental hazards, including burn pits, in the war zones.  The one is significant.  The 30 page training letter marks the first time VA has ever addressed potential battlefield exposures and the first time it has issued guidance on benefits for a war-related health issue without specific direction from Congress or the recommendation of large, independent health organizations.  That's a huge step for an agency that, for too long, has failed to be a proper advocate  for the veterans it is supposed to serve.  And it's proof positive that VA Secretary Eric Shinseki is living up to his promise to better look out for the rights and interests of those who serve.  According to the veterans group Disabled American Veterans, more than 500 vets of the present wars suffer from respiratory illnesses, cancers and other serious medical conditions believed to be connected to war-zone burn pits, the giant open-air fires used in the war zones to incinerate trash, medical waste and more. Cont. next column►►

 

                                     BURN PITS, CONT.
     Many more veterans, however, have been exposed to those same fires.  For some, symptoms may not emerge for years; others may already be suffering undiagnosed symptoms, unaware that their health problems might be related to environmental exposure during their war tours.  It is essential, therefore, that VA follow up its guidance letter with training for claims specialists and outreach to veterans.  The agency has made and impressive first step.  It must now follow through.  ....Marine Corps Times 5/2010 

                    NEW REGULATIONS ON PTSD CLAIMS
     Due to space restrictions, we can't print all of the new rules for PTSD claims. You can read them all at www.va.gov.  There is a link to all of the Questions and Answers there.  Hopefully these rules will facilitate more timely rulings for all claims for PTSD.
1.  This new rule is for Veterans of any age.
2.  The new rule will apply to claims:
     ► Received by VA on or after July 13, 2010
     ► Received  before July 13, 2010 but not yet decided by a VA regional office.
     ► Appealed to the Board of Veterans' Appeals on or after July13, 2010.
     ► Appealed to the Board before July 13, 2010, but not yet decided by the Board and
     ► Pending before VA on or after July 13, 2010, because the Court of Appeals for Veterans Claims vacated a Board decision and remanded for re-adjudication.
                           QUESTIONS AND ANSWERS
     "Stressor Determinations for Posttraumatic Stress Disorder"
►1.  What is Post-Traumatic Stress Disorder (PTSD)?
PTSD is a condition resulting from exposure to direct or indirect threat of death, serious injury or a physical threat.  The events that can cause PTSD are called  "stressors" and may include natural disasters, accidents or deliberate man-made events/disasters, including war.  Symptoms of PTSD can include recurrent thoughts of a traumatic event, reduced involvement in work or outside interests, emotional numbing, hyper-alertness, anxiety and irritability.  The Disorder can be more severe and longer lasting when the stress is human initiated action (example:  war, rape, terrorism).
►2.  What does this final regulation do?  This final regulation liberalizes the evidentiary standard for Veterans claiming service connection for post traumatic stress disorder (PTSD).  Under current regulations governing PTSD claims, unless the Veteran is a combat Veteran, VA adjudicators are typically required to undertake extensive record development to corroborate whether a Veteran actually experienced the claimed in-service stressor.  This final rulemaking will simplify and improve the PTSD claims adjudication process by eliminating this time-consuming requirement where the claimed stressor is related to "fear of hostile military or terrorist activity," is consistent with the places, types and circumstances of their service, and a VA psychiatrist or psychologist, or contract psychiatrist or psychologist confirms that the claimed stressor  is adequate to support a diagnosis of PTSD.

                STOLEN VALOR ACT CHALLENGED, CONT.
     Denver attorney Christopher P. Beall, who filed a friend-of-the-court brief for the American Civil Liberties Union of Colorado, said the Stolen Valor Act is fatally flawed because it doesn't require prosecutors to show anyone was harmed or defamed by the lie.  "The government position was that any speech that's false is not protected by the First Amendment.  That proposition is very dangerous," Beall said.  "It puts the government in a much more powerful position to prosecute people for speaking out on things they believe to be true but turn out not to be true," he said.  Beall said the ACLU was not defending the actions Strandlof is accused of, but took issue with the principle behind the law.
     Rep. John Salazar, D-Colorado, who sponsored the Stolen Valor Act in the House, predicted the decision will be overturned on appeal.  "This is an issue of fraud plain and simple," Salazar said in a written release. "The individuals who violate this law are those who knowingly portray themselves as pillars of the community for personal and monetary gain."
     Pam Sterner, who as a college student wrote a policy analysis that became the basis of Salazar's bill, said the issue isn't free speech but misrepresentation.  Sterner, a former Coloradan who now lives in Virginia, said authentic medal winners' credibility suffers when imposters are exposed because the public becomes suspicious of even true stories of heroism.
     Chapter Note:  For that matter, is the Stolen Valor Act really taken seriously anyway by the FBI Investigators and the US Prosecutors?  Apparently not!  Most receive a slap on the wrist.  Locally, self-appointed Vietnam Veteran Memorial Guard, Kenneth Nelson proclaimed to be a Marine and had received a Silver Star, Purple Hearts, etc.   He did not serve and received no medals. In 2008, documentation was presented to the FBI for investigation.  But it took until 2010 to finally prosecute.  Nelson pleaded guilty.  And just what was his punishment after defrauding the public for over 20 years???  He was declared to have mental issues, so is on probation for one year and ordered to receive counseling. 
     So while our military puts their lives on the line for our country every day, there are those out there taking the credit without serving at all or claiming to be super heroes, and where are the entities that should be enforcing the Stolen Valor Law? Definitely not putting forth the effort to prevent or stop them from continuing to lie to the public.  Generally the decisions that are made re:  these individuals are a slap on the wrist for the offender and a slap in the face for those who are or have served.  So, obviously, Stolen Valor is only an important issue for some, not all.   As for the ACLU, how does committing fraud have anything to do with free speech?
     Those who are the enforcers of the Stolen Valor Act need to STOP coddling the guilty parties and at least apply the punishments outlined in the Act. They need to STOP using the mental illness excuse just to settle the case without determination by experts as to whether the person knows right from wrong.

CARL FERDEL GUIMBELLOT
May 6, 1933 - May 24, 2010
Carl served and retired from the Air Force after 21 years.  He continued serving by volunteering his services to veterans organizations, achieving status and many awards for his service to the VFW.  He held many state and post positions, the latest as Commander for VFW Post #85.  He was also a member of VVA, chapter 500 and was a service officer for the American Legion for a few years as well as the VFW.  Carl was always available to help any veteran with a claim and he did so until he was unable to.  He was laid to rest in the VA Cemetery in Dixon and a reception was held at VFW Post #85.  It was attended by his many friends, his children, and those he helped.  VVA500 sent many veterans to him for help with claims.  He was definitely an expert in the field.  And he was willing to share his knowledge with any who needed it.  We all really miss you Carl!

GOLD STAR MOTHER, EXTRAORDINAIRE
Passed away on July 12, 2010 at the age of 78. Mary was a fiery lady who spoke her mind and was the keeper of a lot of veteran history since the Vietnam War.  Her son Eddy, a Marine was killed in Vietnam.  Her late husband was a Master Sgt. in the Air Force.  After her son's death Mary became active in the Gold Star Mothers and other veteran organizations and remained active until her death.  A few years ago, she was able to visit her son's unit in San Diego and was really thrilled about that opportunity.  She was a great lady and will be missed by many. Memorial Service will be held at VFW Post #4647, 3300 "U" Street, Antelope, on August 4th at 11AM.

Sea Kayaking is a great, low-stress, outdoor recreation.  After kayaking on the East Coast for many years, Steve Keller, Chapter 500 member, and wife Mary, discovered Penguin Paddlers, right in their town of Rocklin.  The owner of Penguin Paddlers is a USAF Pararescue Veteran.  Penguin Paddlers has an active, friendly club, with the average age in the 60's.  They have local and road trips, with clinics and demonstrations.  So it's an ideal recreation for VVA members.  You can ask Steve at t meeting, or contact him at 916-791-6705, or e-mail:  doublekayak@yahoo.com.  The Penguin website is:  www.penguinpaddlers.com.

Hall is located at the corner of Auburn Blvd. and Orange Grove Ave.  There are several ways of reaching the hall, Auburn Blvd. exits off I-80, Madison exit to Auburn Blvd., Watt Ave. to Auburn Blvd.  When you get to the complex, the Hall is on the far end off Auburn Blvd..  Just look for the flag pole in the back corner.
