PRESIDENT'S MESSAGE

     This month closes out my three years as President of VVA500.  We've made lots of progress in those three years and am confident that we will continue to grow and make even more progress by  expanding our services to help Veterans.  I want to thank all of you for your support throughout all of the past three years.  I've enjoyed attending all of the events with the members and representing the chapter when called upon.
     I also want to thank all that expressed your support regarding the controversy with the City and the opening of our new office. The issue will be resolved.  Thanks to all who attended the ceremony at the Memorial, the celebration later at "The Bunker" and all who contributed to the success of the day.  "Welcome Home Vietnam Veterans"!

DON'T MISS OUT!

     Did you go to war before you were able to receive your diploma from high school?  Well, you can still receive that diploma through the Sacramento County Office of Education's annual Operation Recognition.  April 30th is the deadline for applying to receive your diploma at the May ceremony.  You will miss a really great event for you and your families if you don't take advantage of this opportunity.  VVA500 members Hank Davis and Gregory McNeill received theirs last year.  Held at the Sheraton, Veterans were honored with their diplomas at a special meeting of the School Board when the diplomas were presented, treated to refreshments and pictures given to them along with their diplomas.  It's like another "Welcome Home".
     To qualify, applicants must be Sacramento County residents.  Applications also may be submitted by a family member of a qualified individual, living or deceased.  Doesn't matter what war was served in.  The applications are available online at www.scoe.net, or call Cathy Sapunor at 916-228-2416, or e-mail her at sapunor@scoe.net.

     Nominations can also be taken from the floor at the Election Meeting on April 15.  Criteria for any of the above positions is:  your must be a paid up member of VVA and a copy of your DD214 must be on file.  The voting is done by written ballot and then tallied by the Nominating Committee that was elected last year:  Chair, Mike Callison, Joe Cavanagh and Jim Santianna.  AVVA members can only vote for the AVVA representative.  And likewise, VVA members can only vote for VVA members.
     The newly elected President appoints the Committee Chairs.  A listing of the various committees will be provided at the Annual Meeting.  Members can review the listings and choose committees they would like to serve on.  It is not necessary to have every committee position filled.  For many of the committees, the area of interest is taken care of in other ways.  The Committee Chairs will be expected to give reports on their committee work, or bring information regarding the committee subject at the General Meetings.  The committee list can be taken home and considered, but we will need the requests for committee positions no later than the next General Meeting in May as we must file our election report with National VVA in a timely manner.

VETERAN BENEFITS

     VA DENTAL TREATMENT

     We've addressed this issue previously, but since we do still get questions about whether Veterans can get dental treatment from the VA, here again are the guidelines:

     Outpatient dental benefits are provided by the Department of Veterans Affairs according to law.  In some instances, VA may provide extensive dental care, while in other cases treatment may be limited.  Veterans are eligible for outpatient dental treatment if they are determined by VBA to meet one of the following criteria:
►Those having a service-connected compensable dental disability or condition are eligible for any needed dental care.
►Those who were prisoners of war (POW's) and those whose service-connected disabilities have been rated at 100% or who are receiving the 100% rate by reason of individual unemployability are eligible for any needed dental care.
►Those who are participating in a VA vocational rehabilitation program under 38 U.S.C. chapter 31 are eligible for dental care necessary to: 
1.  Enter into a rehabilitation program, achieve the goals of the veteran's vocational rehabilitation program; or prevent interruption of a rehabilitation program; or
2.  Hasten the return to a rehabilitation program of a veteran in interrupted or leave status; or
3.  Hasten the return to a rehabilitation program of a veteran placed in discontinued status because of illness, injury or a dental condition; or
4.  Secure and adjust to employment during the period of employment assistance; or
5.  To achieve maximum independence in daily living.
►Those having a service-connected noncompensable dental condition or disability resulting from combat wounds or service trauma are eligible for repeat care for the service-connected conditions).
►Those having a dental condition clinically determined by VA to be currently aggravating a service-connected medical condition are eligible for dental care to resolve the problem.
►Those with nonservice-connected dental conditions or disabilities for which treatment was begun while the veteran was in an inpatient status in a VA medical center, when it is clinically determined to be necessary to complete such dental treatment on an outpatient basis.
►Those receiving outpatient care or scheduled for inpatient care may receive dental care if the dental condition is clinically determined to be complicating a medical condition currently under treatment.
►Certain veterans enrolled in a VA Homeless Program for 60 consecutive days or more may receive certain medically necessary outpatient dental services.
     There is a whole list of criteria for recently discharged veterans depending on length of service, treatment while in the service, etc.  For those it would be best to contact the OAF/OIF transition teams.  For the Sacramento area, contact :  916-843-9075.

 

LEGISLATIVE ISSUES FOR VETERANS AND MORE

     Here are a few of the bills re:  Veteran issues that are up for consideration in the State Legislature:
     SB1222 - Cedillo - County Veteran Service Officers:  funding.  Would appropriate an amount equal to the aggregate sum of $3 per veteran from the General Fund to the Department of Veterans Affairs for allocation during the 2008-09 fiscal year, for purposes of funding the activities of County Veterans Service Officers.  This bill would also provide for future appropriations in the annual Budget Act, and would require the department to annually determine the total number of veterans who meet the residency requirements set forth in Section 516 of the Vehicle Code, during the preceding fiscal year and to report its determination to the Department of Finance and the Legislature.  The bill provides that the $3 per veteran would be allocated by the department of Veterans Affairs: A.  $2.35 shall be applied to fund the activities of the County Veterans Service Officers; B.  $.50 shall be applied to fund a competitive grant program to allow veteran service organizations to work in conjunction with County Veteran Service Officers in Veterans Outreach Programs. C.  $.15 is to fund increase in staffing in the Veterans Service Division for increased grant and contract administration. (Note:  Based on the current estimate of 2.2 million veterans in the state, the above formulas would be expected to provide $5.17 million for County Veteran Service Officers, $1.1 million for the grant programs, and $330,000 for the Veterans Service Division.)
     SB1220-Cedillo - Housing:  Multifamily Housing Program:  veterans.  Would authorize a sponsor, as defined, of a project funded by the Multifamily Housing Program, to restrict occupancy of a project to persons with veteran status if the veterans to be served possess significant barriers to social reintegration and employment due to a physical or mental disability, substance abuse, or the effects of long-term homelessness that require specialized treatment and services, and the sponsor also provides, or assists in providing, the specialized treatment and services.
     SB1245-Negrete, McLeod, Montclair - California Mexican American Veterans' Memorial.  Would require the Department of General Services, in consultation with the CA Mexican American Veterans' Memorial Beautification and Enhancement Committee, to accomplish specified goals with respect to the design and construction of the memorial.

     We are sorry to report the death of Floyd Volker, on March 30.   He was Past Commander of the Veterans Affiliated Council and past member of VVA500..  Floyd, a retired Special Forces Veteran had been ill for several years.  May he Rest in Peace and our sincere condolences to the families.

WHAT'S GOING ON WITH VVA500'S NEW OFFICE???

     From the top, we had not planned on being "open for business" until any issues re:  permits, etc. were resolved.    But we did want to extend the "Welcome Home Vietnam Veterans Day" celebration to the new offices and be able to show everyone the new facility.  When the Code Enforcement Officer from the City appeared on Monday,  while a few members were moving in some furniture, and was told what we would be doing there, she immediately pressed the issue of possibly having to get a special use permit that could cost $8,000.  Later on, in talking to the building owner and his son, comments were made that they did want any undesirables in the area as well as a comment that we could not move anything in to the effect of  "once they are in, it is hard to get them out". When talking to the owner, she also indicated that if we had the event, moved anything in, opened for business, in all cases there would be fines.  The building owner requested a one day permit for us just to have the event.  This was also not allowed.  Seems strange that an owner can't have an event on his own private property.
     In calling to see what we could do to have the event, we were referred to and attempted to talk to people in the Land Planning Department to explain to them that we had not intended to move in and be open for business until all issues were resolved and were just requesting that we be allowed to have our one day event.  The issues seemed to be whether we were going to have food service, food lines, social services,  things of that nature.  Apparently they were fearful that we were going to be opening another Loaves and Fishes.  Again the request was made for us to at least have the event on Sunday.  This was on Tuesday.  Late Tuesday afternoon, we received a call requesting a detailed description of the programs and services we would be making available.  This was completed Tuesday night and e-mailed as requested so they would have it on Wednesday morning.  We waited Wednesday for a response, receiving none, called regarding a decision.  It was indicated that no decision had been made, the e-mail had been passed on.  However she knew that the matter was urgent, and she was sure that I would be hearing from someone soon.  Thursday came, and no response yet.  Called again, left a message.  No response.  Someone called Friday who had no authority to make any decision and  indicated that the issue had been passed on to Zoning. Everyone was gone for the long weekend.  At that time, we made the arrangements for an alternate site for the "Welcome Home" and notified everyone of the change.  As of this writing, we have yet to receive even the courtesy of a response from any department in the City.  Although some people received a snippy and unprofessional e-mail from Councilwoman Sheedy's office.
     At this time, the City powers at hand seem to be laying all of the blame on the building owner, not having the proper permits, etc.  The building owner is a disabled Vietnam Vet who wants to help all Veterans.  And I repeat, both the owner and VVA500 knew that there would be requirements, that we were willing to comply with before we opened for business, but just wished for one day to have the celebration.

                                       AFTER ACTION REPORT

2/14 - Members Harper, Kauffman, McNeill attended the monthly planning meeting for the 20th Anniversary of the Vietnam Memorial.
2/19 - VVA500 held it's monthly General Meeting. Davis Professor Erickson spoke to the members on his travels throughout Vietnam, Cambodia and several different countries.  In the near future we will have a special presentation by Professor Erickson with slides and much more information.  E.D. McNeill's son, Lt. Col. Carl Unholz (ret) gave a presentation on the various areas of defense the Air Force is involved in, including the current war in Iraq and Afghanistan.
3/1 - The Young Marines held their regular training day.
3/11 - E.D. McNeill attended the Homeless Task Force Meeting.
3/13 - Members Harper, Kauffman, McNeill attended the monthly planning meeting for the 20th Anniversary of the Vietnam Memorial.
3/15 - The Young Marines held the graduation on the current class of recruits.
3/17 - VVA500 participated in the annual St. Patrick's Day Parade in Old Town Sacramento.
3/30 - VVA500 held a ceremony at the Vietnam Veterans Memorial for "Welcome Home Vietnam Veterans Day" and a celebration followed at the "Bunker". (The Torch Club).
4/1 - VVA500 held their regular Board Meeting.  A special presentation was made by the newly formed Marine Cadets.

     On Wednesday March 6th, Sam was moved to the Kentfield Rehabilitation Hospital to continue his rehabilitation treatment.  Kentfield is a private hospital, so a bit different from Palo Alto.  Sam is now in a double room, and it is a little cramped for visitors.  Sam transitioned well but the change is a little harder for Erin.  Sam's new doctor was pleased with the brain scans taken at Palo Alto and feels Kentfield can make positive progress with Sam.  The update on March 18 indicated that Sam was progressing very well, becoming better and better on his alphabet board with correctly spelling words and sentences and even making impromptu statements. The doctor started him on a drug that will hopefully stimulate his ability to speak.  Physically, with hard and long work with the physical therapist, he is also becoming much stronger.

UPDATE ON SGT. SAM, CONT.

     Then on March 27, some problems cropped up.  Sam had a temperature over 100 and up to 104.  Test were run and the doctor said he had a gallbladder infection and pneumonia.  He was sent to Marin General Hospital, where the diagnosis was Sepsis and Pancreatitis and he was being pumped with a lot of antibiotics.  The plan at that time was that he would be there for about a week.  But Erin reported that the staff at Marin General was very attentive and they even ordered speech, physical and occupational therapy for him while he is there.  As of April 3, Sam was consistently improving and getting stronger each day.  More tests were going to be done to make sure there were other problems.  If all goes well, Sam and Erin should be back at Kentfield in a few days.  Be sure to check out Tony's blog for lots of pictures of Sam and Erin.

MORE ON VA DENTAL COVERAGE ........
RESOLUTION INTRODUCED TO EXPAND VA DENTAL COVERAGE BENEFITS

     From the News-Sun Staff Report in Illinois.     ►Veterans with service-connected disabilities would get expanded dental coverage under bipartisan legislation introduced by U.S. Rep. Mark Kirk, Highland Park, Ill.  The "Make Our Veterans Smile Act" (House Resolution 5595) was co-introduced by Kirk and fellow Navy Reserve Intelligence officer U.S. Rep. Chris Carney, D-PA.
     Currently, only 100 percent disabled, homeless or prisoner-of-war veterans are eligible for dental benefits.  The bill, if signed into law, expands dental coverage to any service-connected disabled veteran, regardless of disability rating starting Jan. 1, 2009.  "We need to ensure that those who wore the uniform, risked their lives and sacrificed so much are appropriately cared for," Kirk said.  "We won a great victory for area veterans when we saved the North Chicago VA Hospital from closing.  But the commitment the government makes to help care for disabled veterans is incomplete without addressing their dental needs."
     According to the Veterans Administration, 258.000 veterans currently are eligible for dental benefits.  More than 2.5 additional disabled veterans would receive coverage under the Kirk-Carney bill.


►Chapter Note:  Considering the current budget problem, it is doubtful that this legislation could be accomplished at this time.  But it's a start.  This would mean that an individual that had a rating of only 10% for a service-connected disability could qualify for dental care.  The cost would be enormous.  The negotiation point would be to lower the 100% requirement in increments so at least the veterans with more serious service-connected  disabilities could receive dental care. So, it would not hurt to contact your Congressman or woman in support of this legislation.  The more that respond, the more it could be a serious issue that deserves consideration.

 

1st OEF/OIF WELCOME HOME

     VA Health Care Centers across the United States will be holding the first Welcome Home events for Iraqi and Afghanistan Veterans.  The Director and Staff of the VA Northern California Health Care System invites Veterans and their families to attend.  The specifics are:

     ►The National Archives is joining with another website www.footnote.com/thewall that will enable visitors to search the Wall for people they know and pay tribute by adding photos, comments and stories of those who lost their lives during the Vietnam conflict.  The site is a little clunky right not, but appears to be still in a test mode.

     So, where are we now?  The building owner is working with the City to complete whatever they deem necessary to complete the project.  And it appears that since we have been labeled as a "Social Service Organization" that we will have to go through some additional hoops to get our own Veterans' Hall established.  What we are proposing to do is not much different than many other Veteran Halls, with the exception that it will be a non-alcoholic facility.  Let's hope it will all be as simple as Code Enforcement Director, Max Fernandez said in an interview with Fox 40 news, "We are very sensitive to social service organizations and what they do, and we would never trivialize what they do or be insensitive to their mission.  When the necessary paperwork is turned in, Fernandez says the remodeling project can most likely move forward."
     Obviously, this was a known factor.  However, remodeling was not the issue of the week.  The issue was allowing Vietnam Veterans to finally have an official "Welcome Home Day", as other communities were able to do.  The issue at the time was one day and no response re:  that day.  While city workers were able to take a long weekend and celebrate Caesar Chavez Day, Veterans who have served their country well, evidently did not deserve their day, nor a response. Amazing that protestors of every sort can get permits for wherever they like, or can protest without a permit, but a building owner cannot get a permit for one day on private property.
     We thank everyone for their support in this matter and updates will be provided as they progress.   

THE PUBLIC PERCEPTIONS OF VETERANS

     The veteran community has been assaulted this year with lots of negative public perceptions of what and who a veteran is.  When "The Veterans Village Foundation" tried to open it's newly built Vet House along the Russian River - we were hit by angry neighbors who talked openly about their fears of having us in the neighborhood.  It was ugly talk and they have and continue to have used every tool they could to stop us from occupying the building.  They have used permits and government offices to render our efforts almost hopeless at this stage.
     Over the last month or two we have watched once again how "The Republic of Berkeley" has tried to stop the USMC from recruiting in their city - it is sickening for any veteran or patriot to watch it on the news.
     Then, we hit closer to home when our VVA Offices are stopped from opening.  We got what we thought was insensitive comments and treatment from the city.  People were mad and outraged.  All of us were ready to fight the world over this assault on our pride once again.  It was perceived as yet another case of total disrespect and we were beyond insulted. Even I, the normally more loving and forgiving kind of guy, had enough and I let go with a triad of energy and words against this injustice.     Continued in the next column..........

 

  PUBLIC PERCEPTION, CONTINUED

     Later in the week, we find that things may or may not have been all stacked up against us because we were veterans, or because veterans services are considered social services or it may or may not have been a case of not knowing the rules and permit regulations of this special district, depending on interpretation of whom was doing the talking.
     So, what is the truth and what is a fact in all of this mess and what should we be doing now and in the future?  The sad truth is that the public really has a bad image of veterans and especially those that have PTSD.  The public is fearful and ignorant and reacting emotionally.  Some of this is also a backlash against the present war and the war in Vietnam - which some old hippies have never gotten over.  They feel that they were and are morally right and have used veterans over the decades to vent their own rage.  The media - in the news or in the movies, has not portrayed veterans in the best light either; and so we veterans have become castaways on the shores of our own country. 
     Now the good news:  All the bad headline grabbing stories about our Russian River difficulties have actually brought people forward who felt outraged over the treatment and are offering to help the foundation build newer and better facilities in other states.  The foundation is now sorting out all kinds of offers of help and this is all possible because we were slandered publicly.  So from the all of the bad comes the very seed of good things ahead.
     In Sacramento, I believe that once all of the permits and paperwork is in, the city will work with us and help bring the process together.  The time has come for cooperation and forgiveness on all sides of these issues.  There are no evil indentations by anyone - it is fear and misunderstanding that is the root cause of what has happened and continues to happen across the country.  It is up to all of us now to educate the public and refocus the attention to positive images of the veteran community.
     Even though our President did not sign the official "National Welcome Home Vietnam Veterans Day" proclamation - it makes little difference.  In the end, "it don't mean nothing!"  We veterans have always welcomed home our own brothers and sisters and that is something else we will continue to do.  So from my heart to yours "WELCOME HOME".

     ►VA COMPENSATION GARNISHMENT:  Contrary to popular belief there are some conditions under which VA compensation can be garnished in order to pay alimony or child support.  Although VA compensation cannot be attached or assigned there is no statutory prohibition against garnishment of military retired pay.  Under Public Law 95-30, a veteran's disability compensation can be garnished in order to pay alimony or child support and pursuant to a court order, only if the veteran receives disability compensation in lieu of an equal amount of military retired pay, in accordance with a total or partial military retired pay waiver.  In these cases under Title 5 CFR 581.103, the Veterans Service Center (VSC) withholds disability compensation, and makes a payment in compliance with the garnishment order for certain categories of payees.

VVA500 SPONSORS MARINE CADET PROGRAM

     As you may already know, VVA500 has been a sponsor of the Nor Cal Young Marines for a few years now.  The Young Marine program is an excellent program for youngsters 12-18 or until they graduate to learn military code, discipline, drill, the importance of physical fitness, as well as participate in many functions, and field trips along with some fun activities.  The Young Marines are under the command of VVA500's Vice-President, Karen Anne Winnett.  Young Marine Commander Karen Winnett has initiated a new Marine Cadet Program.  This program raises the bar for Young Marines and to be a part of the Marine Cadets, candidates must complete a 500 word essay as to why they want to be part of the Marine Cadets, of course be proficient in the normal Young Marine requirements and be up to speed in their academic pursuits.  The Marine Cadet Program will concentrate on becoming a top of the line drill team and color guard team and other functions in which they choose to excel.  When they become proficient, they will seek competition opportunities.  The Young Marines may carry their rank achieved over to the Marine Cadets. 
     At the April VVA500 Board Meeting, Marine Cadet 1st Sgt. Clinton Redmond made a presentation to the Board in which he requested that VVA500 also be a sponsor for the Marine Cadets. After several questions from the Board and some discussion, the Board voted unanimously to be a sponsor for the Marine Cadets.

                  THE STIMULUS PAYMENT...HOW TO GET IT..
      Even if you don't need to file taxes, you may still be able to receive the payment.  But you must file a 2007 IRS Form 1040 or 1040A and report at least $3,000. in qualifying income on the form.  Confused???  We can show you how at the next General Meeting.  This can be Social Security, VA Benefits, Pension, Survivors Benefits Income.    Cont. next column......

 

STIMULUS PAYMENT, CONT.

     If you need help before the April 15th, just call the office.  If you file before the April 15th tax deadline, your payment will come sooner.  But if you didn't need to file a return, you should file for the stimulus payment at least by October 15, 2008.  Even if you qualify, but you don't file, you will not receive the payment. 
     Late in March the VA was supposed to be sending out packets of information to recipients of VA benefits who did not file a tax return last year.  In it should be a guide as to how to file also.
      When you do file, don't forget to put "Stimulus Payment" across the top of the form you file.  If you don't normally file, the 1040A should be sufficient.  You can pick up the form at your Post Office, Pick one up at the IRS office at 4330 Watt Ave. or they can be downloaded from the IRS website at:  www.irs.gov.
     Just don't miss out on some extra money.  You'll probably need it for your gas tank.
